2. Facebook, Instagram, & Twitter (a.k.a. X) are not in any way affiliated or involved in the competition.

3. Promoter: For the purposes of these Terms and Conditions, the “Promoter” refers to “Bright River Pty Ltd”, Australian Business Number: 91 679 365 907, Address: 2 Molan Street, Ringwood, VIC 3134, Australia, Email: contact@brightriver.com.au.

4. Agreement: By entering the Competition (a.k.a. a Giveaway or a Sweepstake), the Entrant (“You”) agree to be bound by these terms and conditions, and you agree to comply with and abide by these Rules and the decisions of the Promoter, and you represent and warrant that you meet the eligibility requirements. In addition, you agree to accept the Promoter’s decisions as final and binding as it relates to the content of this campaign. Entrants should look solely to the Promoter with any questions, comments or issues related to the Competition.

5. Eligibility:
5.1 Entrants must be over 18 years old on the date of their entry.
5.2 The Promoter’s competitions are open only to residents of Australia.

6. Entry Period: The Competition begins on 07/06/2025 at 13:30 UTC+11, and ends on 07/07/2025 at 23:59 UTC+11 (the “Promotion Period”). All entries must be received by 23:59 UTC+11 on 07/07/2025. Entries submitted before or after the Promotion Period will not be eligible.

7. Entry:
7.1 Enter the Competition during the Promotion Period online by visiting the entry form, which can be found on the following website at https://brightriver.com.au?rafflepress_page=rafflepress_render&rafflepress_id=2.
7.2 For the Entry to be valid, the Entrant must sign up to the Competition via the entry form, and complete at least one of the tasks set out by the competition in 7.3.
7.3 The available tasks for entry into the competition are: Follow BrightRiverAus on Twitter (X), Visit BrightRiverPtyLtd on Facebook, Like our Page at BrightRiverPtyLtd on Facebook, Visit BrightRiverPtyLtd on Instagram, & Visit our Homepage.
7.4 Completing each individual task in 7.3 are counted as 1 Entry each, and each Entrant are only allowed up to a maximum of 5 Entries in this Competition. A task cannot be completed more than once.
7.5 Automated or robotic Entries submitted by individuals or organisations will be disqualified.
7.6 Internet entry must be made by the Entrant.
7.7 An Individual/Entrant can only enter this Competition once, and any attempt by Entrant to obtain more than the stated number of Entries by using multiple/different email addresses, identities, registrations, logins or any other methods, including, but not limited to, commercial contest/sweepstakes subscription notification and/or entering services, will void Entrant’s Entries and that Entrant may be disqualified.
7.8 Final eligibility for the award of any prize is subject to eligibility verification as set forth below.
7.9 All Entries must be posted by the end of the Promotion Period in order to participate. The Promoter’s database clock will be the official timekeeper for this Competition.

8. Prize Details & Winner Selection:
8.1 The Winner(s) of the Competition will be selected in a random drawing from among all eligible Entries received throughout the Promotion Period. The Winner(s) of the Competition will be notified on or after this date.
8.2 There will be Three (3) winners in total (comprising of 1st, 2nd and 3rd place) in Australia that will be selected at random, within about 14 days after the Promotion Period.
8.3 The random selection will be conducted by the Promoter or its designated representatives, whose decisions are final.
8.4 The odds of winning will vary depending on the number of eligible Entries received.
8.5 All Prizes are valued in Australian Dollars (AUD). The Prize for First Place is ONE (1) $100 AUD Gift Card, Second Place is ONE (1) $50 AUD Gift Card, and Third Place is ONE (1) $20 AUD Gift Card. The Gift Card variety will be selected by the Promoter.
8.6 Additionally, there will be Prizes for First to Tenth (1st – 10th) Place in the form of a Discount Coupon Code valued at “10% off your order, Plus Free Shipping”, to be used at the Promoter’s Online Store at brightriver.com.au. Coupons are single-use and have expiry dates.
8.7 After the Winner(s) are decided, all valid and eligible Entrants will be offered a Discount Coupon Code valued at “$10 Plus Free Shipping”, to be used at the Promoter’s Online Store at brightriver.com.au. Coupons are single-use and have expiry dates.
8.8 Prizes are not transferable and no cash alternatives will be offered.
8.9 Winner(s) will be notified by email at the email address provided in the Entry Information, and/or via social media channels (if provided by the Entrant), approximately within 7 days after the random drawing. The List of Winner(s) will also be published on the Promoter’s Website.
8.10 To facilitate and organise the prize distribution, the Promoter will attempt to get in contact with the Winner(s) to collect Personal Details for Postage purposes (such as Contact Name, Australian Postal Address, etc.). The Winner(s) must respond to the Promoter within 7 days of notification. The Promoter is not responsible for any delay or failure to receive notification for any reason, including inactive email account(s), disabled communications such as blocking/muting/closing/disabling direct messaging on social media, technical difficulties associated therewith, or Winner’s failure to adequately monitor any email account.
8.11 Any winner notification not responded to or returned as undeliverable may result in prize forfeiture. The potential prize winner may be required to sign and return an affidavit of eligibility and release of liability, and a Publicity Release (collectively ‘the Prize Claim Documents’). No substitution or transfer of a prize is permitted except by Promoter.
8.12 In a similar process to 8.9, 8.10, & 8.11, the Promoter will attempt to get in contact with all valid and eligible Entrants to distribute the Discount Coupon Code mentioned in 8.6 & 8.7. The Promoter is not responsible for any delay or failure to receive notification for any reason, including inactive email account(s), disabled communications such as blocking/muting/closing/disabling direct messaging on social media, technical difficulties associated therewith, or Winner’s failure to adequately monitor any email account.

9. Privacy: Any personal information supplied by the Entrant will be subject to the privacy policy of the Promoter posted on the Promoter’s website. By entering the Competition, you grant the Promoter permission to share your email address and any other personally identifiable information. The Entrant agrees that their username and public profile picture from Facebook, Instagram and/or Twitter can be published on the Promoter’s website & social media channels.

10. Limitation of Liability: By entering, You agree to release and hold harmless Bright River Pty Ltd and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from: (i) such Entrant’s participation in the Competition and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (iii) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Promotion; (v) electronic or human error in the administration of the Promotion or the processing of entries.

11. Disputes: This Competition IS GOVERNED BY THE LAWS OF Australia, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Competition, Participants and Entrants agrees that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this Competition, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Australia having jurisdiction. Further, in any such dispute, under no circumstances shall Participants and Entrants be permitted to obtain awards for, and hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees. Participant further waives all rights to have damages multiplied or increased.
